Penal Code, 1860–Secs. 302 & 201–Conviction Death sentence–High reduced it upto the extent of life imprisonment–Family dispute in regard to partition of agricultural land–Cause the death of father, step-mother and step sister at night–Earlier he had tried to commit murder by serving the poisonous sweet–He kept the bodies in trunk and loaded them in different trains Bodies were recovered from different railway stations and were identified by the PW 17–Circumstance of last seen also established –Appellant gave false explanation in respect of absence of victims–Chain of circumstances proving the guilt of appellant–Held, conviction was justified–However, fact that accused administered sweet containing poisonous substance shows his frustration and probably greed for property had attained volcanic dimensions–The intensity of bitterness between the members of the family had exacerbated the thoughts of revenge and retaliation in him–The constant nagging would have to be taken as a mitigating circumstance–High Court was justified in reducing the death penalty into life imprisonment.
