Prevention of Food Adulteration Act, 1954–Secs. 16(1)(a)(i) & 7–Acquittal on the ground that the chili powder was not meant for public sale but it was kept for cooking/ preparation of food in the eating place from where the sample was taken–It would also amount to “sale” u/s. 2(xiii) of Act–Impugned order of High Court acquitting the accused, set aside and conviction restored.
