Indian Succession Act, 1925–Sec. 63–Code of Civil Procedure, 1908–Sec. 100–Will–Establishment–Trial Court and first appellate Court disbelieved the evidence of subscribe and both the attesting witnesses as the contradiction was found as regards to the place of execution and the thumb impression was not found matched–In the second appeal, High Court went into a detailed factual inquiry which was not permissible under the jurisdiction u/s. 100–Impugned judgment passed by the High Court is liable to be set aside.
