Code of Criminal Procedure, 1973–Sec. 389(1)–Narcotic Drugs & Psychotropic Substances Act, 1985–Suspension of sentence–Justification–Sec. 37 of Act stipulates that no person accused of an offence punishable for offences u/s. 19 or 24 or 27A and also for offences involving a commercial quantity shall be released on bail, where the public prosecutor opposes the application unless the Court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and he is not likely to commit any offence while on bail–High Court did not apply the mind to the governing principles–No case was made out for suspension of the sentence–Impugned order deserves to be set aside.
