Negotiable Instruments Act, 1881–Sec. 138–Imposition of fine alone without any sentence of imprisonment–Court can reduce the imprisonment depending upon the nature of the transaction, bonafide of accused, contumacy of his conduct the period for which the prosecution goes on, the amount of cheque involved, social strata to which the parties belong–Court may impose only a sentence of the fine upon the defaulting drawer of the cheque.
