Code of Civil Procedure, 1908–Order 33, Rule 1 & Order 33 Rules 15 & 15A–When the application under Order 33, Rule 1 is rejected, the Court may grant the time to applicant to pay the requisite Court Fee within such time as may be fixed by the Court–Applicants have agreed to pay the required Court Fee–Time of four weeks is granted–Observation of trial Court and High Court that the suit is barred by res judicata, and/or on no cause of action, shall be treated confined for deciding the application to sue as indigent person only–However, it will be open for defendants to move the appropriate application under Order 7, Rule 11.
