Code of Civil Procedure, 1908–Order 8, Rule 1 & Order 9, Rule 7–Application for setting aside the ex-parte proceedings was allowed, however, despite that reply was not filed by petitioner and it was closed–Petitioner approached before the Court without clean hands and did not reveal the true facts–Contradiction in regard to the dates of knowledge–Held, application was rightly dismissed.
