Code of Criminal Procedure, 1973–Sec. 439(2)–Prayer for cancellation of bail with the contention that the accused-respondent caused injuries to first informant of earlier FIR and he is a habitual offender–Trial Judge has exercised the jurisdiction u/s. 439 on the basis of material available on record–Allegations of causing injuries on the legs of the victim and that the accused-respondent is a habitual offender cannot be the grounds for cancellation of bail–These grounds could have been raised before the Trial Court while granting or rejecting the bail to accused-respondent–No allegation against the respondent that he misused the liberty of bail granted to him–Interference declined.
