In the earlier suit, trial Court hold the respondent licensee and a trespasser subsequent to the revocation of the licence–Subsequent suit for recovery of possession–Decreed by trial Court on the ground of findings recorded in earlier suit–Appeal against–Lower appellate Court concluded that the subsequent suit was not hit by res judicata and remanded back the matter–Whether proper ?–Held, no–Findings recorded in the earlier suit were binding and issue already decided was not required to be adjudicated again by way of adducing evidence.
