Penal Code, 1860–Secs. 306/34 [Corresponding Sec. 108/3(5) of BNS, 2023]–Framing of charge–Order of–Sustainabililty–Recovered suicide note explicitly exonerates the petitioners indicating solely that they were the reason behind the deceased’s decision to end his life–It does not contain any direct allegation of harassment, threat or instigation by the petitioners with the intention to induce the deceased to take such a drastic step–Further, the FSL report that “it has not been possible to express a definite opinion regarding authoriship of the blue enclosed disputed writting stamped and marked as Q1–Even if, all evidence on record, including the chargesheet and the statements of witnesses are taken correct, there is no allegation against the petitioners–Petitioners are entitled to be discharged from the offence.
