Motor Vehicles Act, 1988–Sec. 166–Exhibit of documents–Photocopies of un-exhibited documents were submitted at the fag end of trial i.e. at the stage of final arguments–Mere submitting the photocopies of any document does not amount to its proof–Documents are required to be marked as ‘exhibits’ and these are required to be proved in accordance with law–Assessment of income of deceased based on these documents cannot be sustained–Impugned judgment is quashed and set aside and Tribunal is directed to decide the claim petition afresh in accordance with law.
