Motor Vehicles Act, 1988–Sec. 147(1)(b)(i)–Liability of Insurance Company–Vehicle in question was a goods vehicle–Five persons including the driver were insured under the policy–Deceased was a labourer engaged for loading and unloading by the owner of goods–However, at the time of accident, vehicle was in unladen condition–Whether the Insurance Company can be responsible for paying the compensation ?–Held, yes–A person who has been hired to unload the goods at a certain place, would reasonably accompany the driver on the way back after unloading the goods at the respective place and it is apparent that while coming back, they would not have the goods with them, however, he will continue to remain an authorized representative of the goods for the journey back–Only deceased and driver were sitting in the vehicle whereas the capacity of vehicle was 4+1–It points that the deceased was the representative of the owner–Insurance Company was rightly held liable for paying the compensation.
