Indian Succession Act, 1925–Sec. 63–Will–Suspicious circumstance–Two Wills were allegedly executed in favour of the plaintiff–One by her mother and another by her brother–Her brother denied from the execution of Will by her mother in the Will executed by him–The Will Ex. 1 itself stands contrary to the another subsequent Will Ex. 2–Both Wills were relied on by the plaintiff–Therefore, both Wills cannot be held to be correct and valid simultaneously–Further, by relying upon both Wills, the plaintiff herself has given an impression that the ownership of the house property was vested in her mother as also in her brother–Will Ex. 1 stands suspicious.
