Code of Criminal Procedure, 1973–Sec. 457–While releasing the vehicle, Court below directed for payment of Rs. 1,24,200/- –Amount was calculated by the Mining Department behind the back of petitioner, and he was not given the opportunity of hearing–Held, Mining Department is directed to issue the notice and petitioner is directed to file the reply–If no demand is raised, the amount be refunded to petitioner.
