Code of Criminal Procedure, 1973–Sec. 361 [Corresponding Sec. 402 of BNSS, 2023]–Penal Code, 1860–Secs. 325/149, 341/149, 323/149 & 148–Due to imposition of the sentence of fine, petitioner’s service career was effected adversely–He had rendered long years service without blemish–It would be manifestly unjust to obliterate the entirety of his accrued service benefits on account of such singular lapse–Held, the conviction of the petitioner no. 1 shall not ipso facto operate to the detriment of his service entitlements–His LRs. shall be entitled to all such retiral and consequential benefits as may have accrued to him during his lifetime–Directed accordingly.
