Code of Civil Procedure, 1908–Order 7, Rule 11–Rejection of application–Justification–Suit for cancellation of sale deed which was executed by the defendant nos. 2 & 3 in favour of defendant no. 1–Plaintiff paid the Court Fees of Rs. 891/- only–He had to pay the Court Fees as per the valuation of the property–Further, plaintiff had not got declared himself as the owner of the property, therefore, he had no right to file the suit for cancellation of sale deed–Trial Court committed error in dismissing the application.
