Employee’s Compensation Act, 1923–Sec. 4A(3)(b)–High Court reduced the penalty of 50% of award to Rs. 30,000/- –Specific findings of Commissioner that the respondent no. 2-employer had not paid any amount to the claimants at the time of injury nor he paid anything when the claim was filed by the appellants–Such findings could not have been recorded by the High Court–In order to meets the ends of justice, amount of penalty is fixed at 30% of the compensation amount.
