Code of Civil Procedure, 1908–Order 1, Rule 10–Rejection of application–Writ Petition against–Dealing with–In the writ petition, a notice must be issued to the proposed party as in the case the writ petition is accepted and it is held that the proposed party is necessary party, the opportunity to file the application under Order 1, Rule 10(2) before the trial Court would not be available to the party which is ordered to be impleaded under the order of High Court.
