Code of Civil Procedure, 1908–Order 1, Rule 10(2)–If a party is impleaded without issuing any notice to it as a proposed party, an opportunity to file application under Order 1, Rule 10(2) is always available to such to plead that in fact is not a necessary party to the suit–Trial Court can take a different view from the view taken by it at the time of passing the impleading the said party.
