Rajasthan Court Fees & Suit Valuation Act, 1961–Sec. 51, Art. 11(j)–Indian Succession Act, 1925–Sec. 225–Application for granting probate–Proceedings were converted into the application for grant of letter of administration–Application u/s. 51 requiring the plaintiff to pay Court fees in term of Art. 11 (j)–Dismissed–Proceedings became contentious and applicability of Art. 11 (j) is required to be examined–Order impugned set aside and directed to register the proceeding in regular suit and directed the plaintiff to pay ad volaren Court fees.
