Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989–Sec. 3(1)(r), 3(1)(m), 3(1)(f) & 3(2(va)–Penal Code, 1860–Secs. 323, 341, 447 & 504–FIR for the offence–Sustainability–Civil dispute between the parties for declaration of khatedari rights–In spite of court order, defendants transferred the land in favour of complainant through regd. sale deed–Occurrence took place when the petitioners were ploughing the land and complainant obstructed–If they had not obstructed and gone to the disputed property, there was no reason that the petitioner would have been committing the alleged offence–Further, the occurrence did not take place for the reason that the respondent no. 2 was a member of SC–FIR is liable to be quashed.
