Land in Indira Gandhi Canal Colony Area) Rules, 1975–Rules 23(2) & 13 (9)–Father of petitioners was allotted 25 bighas land on a temporary basis–Application for permanent allotment was pending–Meanwhile, 7 bighas and 4 bighas land out of this land was allotted to other persons–View of BOR in revision that the temporary allotment made to father of petitioner came to end and no application for allotment of petitioners was pending–Record of case revealing that the application filed by petitioners under Rule 13(9) is still pending–Judgment passed by BOR is erroneous–Set aside and matter remanded back to BOR for deciding afresh.
