Penal Code, 1860–Sec. 306 [Corresponding Sec. 108 of BNS, 2023]–Conviction u/ss. 304-B & 498-A was converted by the High Court u/s. 306– Brother of deceased gave an account of events in a very natural manner that does not seem exaggerated or untruthful in any manner–Appellant-mother-in-law used to physically and verbally abuse the deceased with regard to demand of dowry–Deceased had to return to her parental home seeking refusal–Abuses hurled at the deceased by the appellant on the day of incident unfortunately acted as a shaw that broke the camel’s back and led her to commit suicide–Guilt of appellant u/s. 306 has been proved–High Court has adequately considered the ground of old age of the appellant as a mitigating factor and awarded the sentence–Interference declined.
