Limitation Act, 1963–Art. 136–Execution of decree–Objection of limitation–Clause 6 of the compromise decree reveals that the appellant surrendered the land to State Govt. during the pendency of the suit and if due to such surrender, the respondent-decree holders were to lose the possession of land then the appellant would give 1 bigha and 5 biswas land to them–Cause of action arose when the respondent lost the possession i.e. on 31.03.1994–Execution was filed within twelve years from this date–Held, it was rightly held to be in limitation.
