Code of Civil Procedure, 1908–Order 5, Rule 17 & Order 9, Rule 13–Service of summon–Refusal by petitioner-defendant to accept the summons–Process server affixed the copy of summons along with the copy of plaint on the wall of premises–It was endorsed on the back of summons that they were affixed on the right door of house, however, on the eastern side of house, no door is existed–Service of summons was not proper–Held, ex-parte decree was rightly set aside.
