Penal Code, 1860–Secs. 498-A & 304-B–Conviction–Veracity of dying declaration–Deceased committed suicide by pouring kerosene–Dying declaration was recorded by Executive Magistrate–She was fully conscious and in a position to give statements–No case of tutoring before making the statements–Contention that the dying declaration was not recorded in question-answer form is also not acceptable as the due precautions were kept by the Magistrate and he appeared in the witness box and deposed up to this effect–Cause of committing suicide was regular fights with mother-in-law on account of dowry demand–Held, conviction of mother-in-law is confirmed, however, appellant-husband is entitled to get the benefit of the doubt.
