Protection of Women from Domestic Violence Act, 2005–Sec. 2(q)–Respondent–Purview of–One suit by appellant SC for permanent injunction and declaration–Another application by respondent S u/s. 12 of DAV Act–For the purpose of determination of rights of defendant (respondent S) u/ss. 17 & 19 r/w. 26 in the suit in question, the plaintiff (appellant SC) can be treated as respondent but for the grant of any relief to her or for successfully resisting the suit of the plaintiff, the necessary conditions for grant of relief as prescribed under the Act of 2005 has to be pleaded and proved by the defendant, only then the relief can be granted by the Civil Court to her.
