Code of Criminal Procedure, 1973–Secs. 195(1)(b)(ii)–Penal Code, 1860–Secs. 420, 467, 468, 471 & 120B–Transfer certificate was forged and fabricated prior to it was presented before the returning officer alongwith nomination paper–It cannot be held that the document was forged while it was in custody of Court–Bar u/s. 195(1)(b)(ii) is not attracted.
