Code of Criminal Procedure, 1973–Sec. 125 [Corresponding Sec. 144 of BNSS, 2023]–Order of awarding the maintenance–Sustainability–Impugned order is totally unreasoned and there is no consideration of evidence which was available on record–Trial Court has not referred to the criteria based upon which it awarded the amount in question–Affidavits as specified in Enclosure 1 and Enclosure 2 were not filed nor the Trial Court asked the parties to file the same–Impugned order is quashed and set aside and Trial Court is directed to decide the matter afresh.
