Evidence Act, 1872–Secs. 91 & 92–Permanent Injunction & Declaration–Pleading in the plaint that a written agreement was arrived at between the plaintiff and the original owner of land–However, no such agreement was placed on record–Claim of plaintiff that the contents of agreement would be proved by adducing the secondary evidence that too by way of oral evidence–Issue could have been proved only by way of producing the original document of agreement or at least copy of agreement as secondary evidence–In absence of production of the document of agreement, oral evidence to prove the execution of agreement and contents of agreement are not admissible in law.
