Indian Succession Act, 1925–Secs. 263 & 372–Court below revoked the probate which was granted earlier in favour of petitioner and issued the succession certificate in favour of respondent–Appreciation of–Probate cannot be granted on the ground of a suspicious will–Respondent is the married wife of deceased–Merely because, the name of appellant was mentioned in the life insurance policy of deceased, she cannot be deemed the successor of deceased–Further, she failed to prove that her children were born with contegion of deceased–Held, no error is found in the impugned order.
