Code of Civil Procedure, 1908–Order 7, Rule 11, Order 7, Rule 10 & Sec. 151–Application for rejection of plaint on the grounds that the suit has not been filed on the proper Court Fees and notice u/s. 80 CPC was not given to Registrar–Dismissal of application–Suit for cancellation of sale deed–At the stage of deciding the application, Court has to look into only plaint–Grounds mentioned in application are not found in plaint–Further, objection taken by petitioner-defendant are the mixed questions of facts and law which cannot be decided without framing the issues–Held, application was rightly rejected.
