Code of Civil Procedure, 1908–Order 6A, Rule 8 & Order 6, Rule 17–Counter-claim was filed by way of seeking the amendment in the written statement–Permission was granted–Appreciation of–Suit was registered on 08.04.2012 and the amendment in the written statement was sought within three years–Suit has not proceeded substantially because the issues have not been framed–Observation of trial Court that the written statement was filed in the limitation and if the amendment sought is not allowed, the same will lead to multiplicity of proceedings–Plaintiff has every right to file the written statement of the counter-claim–Issue of pecuniary jurisdiction can also be raised in the written statement–No prejudice is going to be caused to the plaintiff–Interference declined.
