Code of Civil Procedure, 1908–Order 7, Rule 14(3)–Family Courts Act, 1984–Sec. 9(1), (2)–Family Court allowed certain documents along with additional affidavit to be taken on record–Writ petition against–Prior to filing the affidavit, both the proceedings u/ss. 9 and 13 were consolidated–Therefore, time for filing the affidavit was allowed by trial Court–Provisions of CPC are applicable in the proceedings before family Court subject to other provisions of Act–Nothing contained in Secs. 9(1) or 9(2) to prevent the family Court from laying down it’s own procedure–Held, no scope is made out for interference.
