Code of Criminal Procedure, 1973–Secs. 433-A, 432 & 433–Constitution of India, 1950–Arts. 72 & 161–Scope–Sec. 433-A can restrict the powers under Secs. 432 or 433 but cannot restrict the powers under Article 72 or 161–In other words-powers of President of India and Governer being the Constitutional powers, cannot be under restriction imposed by Sec. 433-A.
