Penal Code, 1860–Sec. 302–Evidence Act, 1872–Sec. 9–Conviction–Circumstantial evidence–PW 1 was not very clear about the extra-judicial confession made by the appellant–Further, there was a threat exerted in order to find out the truth in the Panchayat–PW 2 also stated that he came to the place where the appellant made the extra-judicial confession after the statement of threat was made to other persons–No discussion as to whether the blood stains found in the material object tallies with the blood group of deceased–Conviction cannot be sustained.
