Code of Civil Procedure, 1908–Order 5, Rule 20 & Order 9, Rule 13–Limitation Act, 1963–Sec. 5–Prayer to set aside the ex-parte decree with the contention that the summon had not duly served on account of the change in address–Trial Court had came to knowledge that the appellant had been residing in Ajmer but no information was given in regard to his new address–Trial Court rightly observed that the service of summons by way of substituted service through publishing in a newspaper was complete–Further, the application for setting aside the decree was filed after delay of six years–Appellant refused to serve the notice of execution proceedings–Therefore, the Court below was right in observing that the decision was definitely known to him–Interference declined.
