Specific Relief Act, 1963–Sec. 16(c)–Readiness and willingness of plaintiff–Establishment–No document was produced by the plaintiff of show that he paid the balance sale amount of Rs. 4,000/- within a period of one year–He also failed to show that he was having the cash amount of Rs. 4,000/- during this period with him or was in capacity to make the payment–Legal notice was issued after expiry of period of one year and no amount was sent–No evidence is also available to show that he persuaded the defendant for vacating the premises–Contention that he was agreed to get the sale deed registered without vacation of premises is beyond the terms of agreement–Readiness and willingness of plaintiff is not established.
