Penal Code, 1860–Secs. 364, 120-B & 147, 302, 201 & 396–Conviction–Sustainability–Circumstantial evidence–Evidence of extra judicial confession was rightly discarded by the High Court as the prosecution did not examine the handwriting expert for proving the handwriting contained in the inland letter allegedly addressed to PW 19–Statements of witnesses of last seen were recorded after six months and no T.I. Parade was hold–Body of deceased was recovered in decomposed condition–Skull superimposition test was not supported by any other reliable evidence like DNA report or postmortem report–Motive also could not be proved–Non-explanation u/s. 313 would not be a ground to arrive at irresistible conclusion that the accused were involved in the crime–Conviction cannot be sustained.
