Rajasthan Rent Control Act, 2001–Sec. 20(3)–Constitution of India, 1950–Art. 227–Scope–In appeal against the final order of eviction, the restriction laid down vide explanation of Sec. 20(3) does not apply and Appellate Court is free to assess the mesne profit without any statutory restriction–Same principle applies on the High Court while hearing a writ petition against the final order passed by the Appellate Rent Tribunal–Amount of Rs. 15,000/- per month is fixed as mesne profit in view facts of case.
