Penal Code, 1860–Sec. 149–Establishment of offence–Essential ingredients:
(1) there must be an unlawful assembly,
(2) accused must be a member of such assembly,
(3) such unlawful assembly should have been joined by the accused intentionally or should have continued with that knowledge,
(4) accused was acquainted with the common object of the unlawful assembly,
(5) as a member of unlawful assembly, the accused must be knowing that an offence is likely to be committed, and
(6) it must be shown that the incriminating act was done to accomplish the common object of unlawful assembly.
