Specific Relief Act, 1963–Sec. 12–Decree of specific performance–Appreciation of–Readiness and willingness of plaintiff–Plaintiff proved that he was ready and willing to execute the sale deed in pursuance of the agreement to sale dated 22.03.2013–He sent the notice to the defendants on 29.05.2013 to accept the balance amount of sale consideration and get the sale deed registered–He also sent a telegram–Defendants concealed the fact regarding the acquisition of the part of land, for which the agreement was executed and got the compensation–They failed to prove that the documents produced by the plaintiff as regards to sufficient balance in his account are forged–Held, Trial Court rightly concluded that the plaintiff was ready and willing to execute the agreement of sale.
