Evidence Act, 1872–Sec. 32–Dying Declaration–Deceased was very serious–Doctor stated that he would not survive–He thought to record the statement on his own without waiting for any other intervention–Doctor stated that the deceased was found in fit mental state–His satisfaction cannot be discarded simply on the surmises and conjectures– Other dying declaration was recorded by the SHO in form of parcha bayan–No conflict/discrepancy/ inconsistency on material aspect in two dying declarations–Reliance can be placed over both documents.
