Workmen’s Compensation Act, 1923–Sec. 2(d)–Whether the parents would be included within the definition of dependent under the Act ?–Held, yes–In the document, denying the compensation under the Chief Ministers Relief Fund, there was no adjudication as to whether the deceased was wife of G–Commissioner was not justified in placing the reliance on this document–He was required to analyse the entire evidence available on record including the statements of witnesses as well as the documents exhibited for deciding all issues, more particularly, the issue of dependency of the appellants upon the deceased and the deceased being married to G–Impugned order quashed and set aside and matter remanded back for deciding afresh.
