Penal Code, 1860–Secs. 420, 406, 384 & 120-B–FIR for the offence–Sustainability–Dispute as regard to payment of construction work–Averments up to effect that no payment was made till March 2021, is found falsified–Full payment was not made but from the acts of petitioner, it cannot be said that even he was having dishonest and fraudulent intention–Further, there is no delivery of property in pursuance of threat or coercion, therefore, no case of extortion is made out–FIR is liable to be quashed.
