Penal Code, 1860–Sec. 302 [Corresponding Sec. 103 of BNS, 2023]–Conviction–Proper Section–Appellant and other occupants of his vehicle were chased and confronted by a group of five persons after the vehicle accident–During the heated arguments, appellant picked up an iron road and hit the deceased–There can not be any intention to cause death alleged but there is definitely an intention to cause bodily injury which resulted into death–Case falls under Exception I–Conviction deserves to be altered u/s. 304 Pt. I.
