Penal Code, 1860–Secs. 307 & 397–Discharge from the offence–Intention or knowledge of the commisison of offence and doing an act towards it, are the two ingredients of the offence u/s. 307–Intention is to be inferred from the various considerations, i.e., the nature of the weapon, the part of the body chosen for inflicting injuries and the nature of injuries and the circumstances in which the incident took place–Both the ingredients are missing–Held, Trial Court has not committed error in discharging the accused from the offence u/ss. 307 & 397.
