Code of Civil Procedure, 1908–Order 2, Rules 2 & 4–Scope–Plaintiff can also claim mesne profit or arrears of a rent in the suit filed for ejectment of the tenant–He can also further file a suit for claiming mesne profits of arrears of rent for the period subsequent to the decree passed in the earlier suit having became final–But in a case where the plaintiff has claimed mesne profit or arrears of rent in a suit filed for ejectment of tenant and he has relinquished his rights vis-a-vis mesne profit of arrears of rent in the suit proceedings itself, the provisions of Order 2, Rule 2 will come into play.
