Prevention of Corruption Act, 1988–Sec. 17A–Registration of FIR without obtaining the approval u/s. 17A–Sustainability–It is not a case of the arrest of the petitioners on the spot while they were committing or attempting to commit an offence under the Act–Negative final report has been filed in regard to the fact that the petitioner R fleed away from the scene with the alleged electronic devices–Allegation of demanding illegal gratification relates to the discharge of official duties of petitioner and no prior approval of the competent authority has been obtained–FIR is totally illegal and amounts to gross abuse of process of law–Quashed.
