Evidence Act, 1872–Sec. 68–Petitioner sought to ‘x’ mark the thumb impression of the executor of Will–Trial Court declined to grant the permission–Appreciation of–As per Section 68 of the Indian Evidence Act, the document is to be proved on the basis of attesting witnesses, if they are alive and further to test the veracity of the same, the person/material which can show correctness of the document/Will and the veracity of the same may brought before the Court to prove the contents of the same –Procedure provided u/s. 68 has not been followed–Interference declined.
